On a sunny summer morning, our client decided to take his moped out for a drive to the office. As he was heading south on north Elston Avenue just south of Diversey, a car turned directly in front of our client’s path. Our client attempted to avoid the motorcycle collision and was tossed directly onto the road. He was immediately rushed to the hospital where they diagnosed him with several sprains and contusions but then discharged him the same day. Several days later his symptoms worsened, and he lost sensation to one of his legs. He returned to the hospital and was sent to see a specialist. The specialist diagnosed our client with nerve damage to his right leg that would require significant therapy.
Unfortunately for our client, therapy, while helpful for mobility and strength, did not help him regain sensation in all areas of his leg. After several discussions with his specialist about potential options for surgery, he ultimately decided against it. At first the other driver’s insurance attempted to apportion blame on our client for failing to keep a proper lookout. After we overcame that feeble attempt at shedding responsibility, the insurance company made an offer for $100,000.00, citing the lack of any surgical intervention, and low totals in medical bills. After we rejected their offer, we pivoted strategically to pursue an award that exceeded the policy holder’s limits. Within 14 days we were able to resolve the matter for the policy limits of $250,000.00. In yet another example of not compromising in the face of unreasonable hurdles and not stooping into a negotiation that does not begin in good faith, we were able to provide justice for our client.
