Personal injury lawyer, David A. Baez, from Willens & Baez, recently resolved a car accident case for $250,000. The accident involved two vehicles and happened in Aurora, Illinois. A lawsuit was filed in Kane County.
Willens Law Offices’ client (21 years old) was heading eastbound on Plum Street approaching the intersection of Wilder Street. She did not have a stop sign or light at the intersection.
The defendant was driving northbound on Wilder Street at the intersection of Plum Street with the intention of heading west onto Plum Street (making a left). The defendant had a stop sign. He failed to yield the right of way to eastbound traffic and entered the intersection causing a collision between his vehicle and the Willens’ client’s vehicle. The defendant was cited for failure to yield the right of way. Damage to the two vehicles was substantial.
As a result of the car accident collision, Willens’ client suffered a comminuted displaced right distal humerus fracture (her dominant arm) that required open reduction internal fixation. The procedure necessitated the implementation of two plates, cerclage wire, and nine screws.
The case went to mediation in front of the Honorable Robert G. Kleeman, (Ret.). The defendant came into the mediation with no offer. After a full day of mediation, the case was resolved for $250,000.
