On April 21, 2020, Willens & Baez filed a wrongful death lawsuit in the Lake County, Illinois Circuit Court. The lawsuit arises out of a motor vehicle collision that occurred between a mini-van and a semi-truck in Long Grove, Illinois on February 27, 2020. At approximately 11:00 a.m, the defendant was driving her mini-van southbound, towards the intersection of Route 83 and Westmoreland Drive. At the same time, the now-deceased was driving his vehicle northbound, towards the intersection of Route 83 and Westmoreland Drive. Then, the defendant attempted to turn eastbound onto Westmoreland Drive in front of the now deceased’s vehicle, causing a collision. The decedent’s vehicle subsequently went off the road striking a light pole, guard rail, control box, and trees.
The decedent’s sole heir, his daughter, retained Willens & Baez to help her navigate her wrongful death case. Willens & Baez’ lawsuit states, amongst other things, that the defendant, in violation of Illinois law, 625 ILCS 5/11-902, negligently failed to yield the right-of-way, when making a left turn, to a vehicle approaching from the opposite direction in an intersection.
Despite issues surrounding COVID-19, Willens & Baez has already begun its investigation to the events surrounding this tragedy and seeks all available damages under the Illinois Wrongful Death Act (740 ILCS 180/). The decedent’s daughter suffers from profound grief, sorrow, and mental suffering. Willens & Baez intends to hold the defendant liable for her negligent conduct.
Prior to the wrongful death lawsuit being filed, the decedent’s adult daughter was recognized as his only heir by the Lake County Illinois Probate Division and she was appointed as the Independent Administrator of his estate.
