On September 19, 2020, our client was on her way home following her shift as a correctional officer. While on US-52 and Townhouse Road in Big Grove Township, Kendall County, Illinois, a Grain Truck made a left hand turn directly in front of our client’s path. What followed was a violent collision with a grain truck that left our client unconscious and with severe orthopedic injuries. Our client had to be extracted from the vehicle, and transported via emergency helicopter, to Good Samaritan Hospital where she underwent extensive surgery for hardware installation to her right femoral shaft and left tibial shaft, a left knee procedure, and extensive debridement and irrigation to remove a significant amount of plastic found inside of her legs from the collision.
Attorneys for the driver of the grain truck attempted to point the blame at our client for allegedly traveling at 20 MPH over the posted speed limit; in an effort to absolve themselves from any and all liability. They also attempted to place blame on the configuration of the road, by stating that our client was not visible, prior to beginning the turn, because of a significant dip or depression in the road. Through diligent site investigations, extensive discovery, and the procurement of proper experts, we were able to undermine all potential defenses proffered in this matter. Two years of extremely aggressive litigation, ultimately led to this favorable outcome for our client.
