On April 10, 2013, Willens Law Offices filed a lawsuit in Cook County on behalf of a woman who was seriously injured in a car accident.
The accident happened while the plaintiff was driving her automobile northbound on I-294, near the ramp to I-80 in Bremen Township, Cook County, Illinois. On May 24, 2011, in the early afternoon hours, the plaintiff was slowing down to yield to traffic when she was rear ended by the defendant.
The injured party (the plaintiff) is from Colorado. She originally hired a lawyer from Colorado to handle her case as a claim, but when the defendant’s insurance company offered her far less than even her medical bills, Chicago personal injury lawyers, Willens Law Offices, were brought in to litigate this matter.
Willens Law Offices promptly filed Complaint at Law and alleged certain statutory violations such as the defendant was driving his vehicle too fast for the conditions of the roadway, in violation of 625 ILCS 5/11-601 and that he drove his vehicle too close to the plaintiff’s vehicle, in violation of 625 ILCS 5/11-710. The lawsuit seeks compensation under Illinois law, which includes things such as medical bills (past and future), lost wages (past and future), pain, suffering and disability.
While a certain percentage of cases can settle without litigation, this is not always the case. Insurance companies are not always willing to resolve cases at fair values, at least initially. Willens says, “The insurance company wanted a fight. Well, now they got one.” Just because a lawsuit was filed does not mean that this case will have to be tried. Often, insurance companies will want to enter into negotiations as the litigation moves forward. This is especially true if the lawyers representing the plaintiff have a long record of success in handling personal injury cases.
